Welcome to LostNFoundAI, a platform provided by Lost N Found LLC ("LostNFoundAI", "LNF", "we", "us", or "our"). By accessing or using our mobile application ("App") or website ("Website"), you ("User" or "Users") agree to be bound by these Terms of Service ("Terms"). Please read this document carefully before accessing or using the App or Website. If you do not agree to these Terms, you may not access or use the App or Website.

You agree to:

• Comply with these Terms, and check this page from time to time to ensure you are aware of any changes;
• Comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
• Use the latest version of the App and/or Website;
• Take reasonable measures to protect the security of your login information.

You agree that you will not:

• Use our Services for any harmful, illegal, or nefarious purpose
• Post or share Prohibited Content;
• Solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other users or disseminate another person's personal information without his or her permission;
• Solicit money or other items of value from another user, whether as a gift, loan, or form of compensation;
• Use another user's account;
• Use our Services in relation to fraud, a pyramid scheme, or other similar practice;

If at any time you cease to meet these requirements, all authorization to access our Services or systems is automatically revoked, and you must immediately delete your account, and we retain the right to remove your access to our Services without warning.

Description of the App

LostnFound is a mobile application designed to facilitate the process of finding lost items and reuniting them with their owners. The App allows users to purchase LNF TAGS, for example in the format of QR codes in the physical form (stickers, lanyards, keychains, bracelets etc.) which can be attached to personal items. Users can then register their items in the App and scan these LNF TAGS QR codes to assign them to their respective items. Each item contains a name, at least one picture and a description text. When someone finds a lost item, they can scan the LNF TAGS QR code with their phone, which directs them to a web or in-app page displaying the item details and a way to contact the owner of the item.

User Accounts

Registration

In order to use certain features of the App, you will be required to create a user account. When registering for an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Information

By creating a user account, you agree to provide us with your full name, phone number, email address, and full address. You may also choose to enable location sharing when communicating with other users through the App. Any information provided by you will be treated in accordance with our Privacy Policy.

Age Restrictions and Safety

No use by underage persons.

Our services are intended only for legal adults. No persons under the age of eighteen (18) years (or the age of majority in places where eighteen (18) years is not the age of majority) may attempt, directly or indirectly, to view, download, possess, or otherwise use our services.

You must be a legal adult. 

By accepting this agreement, creating a user account (as defined below), and entering a date of birth for age verification purposes, you affirmatively represent and warrant that:

• You are currently eighteen (18) years of age or over (or the age of majority in places where eighteen (18) years is not the age of majority);
• You are capable of lawfully entering into and performing all the obligations set forth in this agreement;
• You are not located in a country that is subject to a u.s. government embargo, or that has been designated by the u.s. government as a “terrorist supporting” country; and
• You are not on any list of u.s. government list of prohibited or restricted lists.

Safety

Your interactions with other members; no criminal background or identity verification checks.  

Please note that LostNFoundAI does not control any of the things our users say or do. You are solely responsible for your use of our services and your interactions with other users (whether on or off LostNFoundAI services).  LostNFoundAI makes no representations or warranties as to the conduct, identity, intentions, legitimacy, or veracity of any users.

LostNFoundAI does not currently conduct criminal or other background screenings of our users.  LostNFoundAI reserves the right to conduct any criminal background check or other screenings (such as sex offender registration searches) at any time and to use available public records for any purpose.

LostNFoundAI does not inquire into the backgrounds of our users or attempt to verify the information provided by our users in connection with account creation, including the accuracy of the date of birth reported for age verification purposes.

LostNFoundAI does not verify the information provided by users with respect to users’ identity or otherwise.

Purchase of Stock LNF Tags and Sponsored LNF Tags

Users have the option to purchase stock tags that can be claimed as their own and attached to personal items. The App may offer sponsored tags featuring logos of companies or organizations. These tags may be provided to users for promotional purposes.

Advertising

Our Services may contain advertisements and promotions offered by third parties and links to other websites or resources. By using the App, you agree to be exposed to such advertisements. LostNFoundAI may also provide non-commercial links or references to third parties within its content. LostNFoundAI is not responsible for the availability (or lack of availability) of any external websites or resources or their content. Furthermore, LostNFoundAI is not responsible for, and does not endorse, any products or services that may be offered by third-party websites or resources. If you choose to interact with the third parties made available through our Services, such party's terms will govern their relationship with you. LostNFoundAI is not responsible or liable for such third parties' terms or actions.

Payment

Payment Processing

All payments made for purchases within the App are processed through third-party payment processors. By making a purchase, you agree to abide by the terms and conditions of the respective payment processor.

Pricing

Prices for LNF Tags and other items available for purchase within the App will be displayed in the currency of your region. LostNFoundAI reserves the right to change the prices of items available for purchase within the App at any time, without prior notice.

Refunds

At LostNFoundAI, we strive to provide our customers with a seamless and satisfactory experience. If you are not entirely satisfied with your purchase, we offer refunds on orders that have not been shipped yet. Please review the following refund policy to understand our procedures and eligibility criteria:

Refunds are available for orders that have not yet been shipped. Once an order has been shipped, it is no longer eligible for a refund.

You may request a refund for an unshipped order within a reasonable period after placing the order. This period may vary depending on the processing time required for your order.

How to Request a Refund

To request a refund for an unshipped order, please follow these steps:

1. Send an email to our customer support team at support@LostNFoundAI with your order details, including the order number and the reason for the refund request.
2. Our customer support team will review your request and confirm whether your order is eligible for a refund.
3. If your order is eligible for a refund, we will initiate the refund process. The refund will be issued to the original payment method used for the purchase.

Refund Processing Time

Refunds will be processed within a reasonable period after approval of the refund request. Please note that the processing time may vary depending on your payment method and financial institution.

Once the refund has been processed, you will receive an email notification confirming the refund amount and providing any relevant details.

Taxes

Prices displayed within the App may not include applicable sales taxes, value-added taxes, or other similar taxes, which may be added to your purchase total where required by law.

Billing Errors

In the event of a billing error or unauthorized transaction, please contact our customer support team immediately atsupport@lostnfound.ai.

Payment Security

Security Measures

LostNFoundAI takes reasonable measures to secure payment transactions made within the App. However, you acknowledge that no method of transmission over the internet or electronic storage is completely secure, and LostNFoundAI cannot guarantee the absolute security of your payment information.

Third-Party Payment Processors

LostNFoundAI does not store your payment information directly. All payment information is securely handled by third-party payment processors in accordance with their respective privacy and security policies.

Privacy

Privacy is important to us. We have a separate policy about it that you should read.

For information about how we use and share your personal data, please read our Privacy Policy. By using our Services, you agree that we may use your personal data in accordance with our Privacy Policy.  

Limitation of Liability

Tag Expiration

LostNFoundAI reserves the right to update or modify the expiration date of the LNF Tags QR code provided through the LostnFound App and Website at any time, without prior notice. Such updates may be necessary to ensure the continued effectiveness, security, and functionality of the LNF Tags. You acknowledge and agree that it is your responsibility to stay informed about any changes to the expiration dates and to update your tags as required. We shall not be liable for any loss, damage, or inconvenience resulting from the expiration or deactivation of LNF Tags due to such updates.

Loss of Items

User understands that while the LostNFoundAI App aims to facilitate the return of lost items, LostNFoundAI does not guarantee the successful recovery of any lost items. LostNFoundAI shall not be liable for any loss, damage, or harm arising from the failure to recover a lost item through the use of the App.

Delete Account

User is responsible for either selecting Delete account within the Lost N Found AI app or send email correspondence to support@lostnfound.ai with the Subject Line "Delete Account" and the correct user id and email address must be provided in order to process the account deletion.

Accuracy of Information

Users acknowledge that the information provided within the LostNFoundAI App may not always be accurate or up to date. LostNFoundAI does not warrant the accuracy, completeness, or reliability of any information provided within the App. LostNFoundAI shall not be liable for any loss, damage, or harm arising from reliance on inaccurate or incomplete information provided within the App.

Waiver of Liability

User hereby waives any and all claims, demands, causes of action, or liabilities against LostNFoundAI, its affiliates, officers, directors, employees, agents, successors, and assigns, arising out of or in connection with the loss of items and the accuracy of information provided within the LostNFoundAI App.

Indemnification

User agrees to indemnify and hold harmless LostNFoundAI, its affiliates, officers, directors, employees, agents, successors, and assigns, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with User's use of the LostNFoundAI App.

 Governing Law

This Waiver shall be governed by and construed in accordance with the State of Arizona Laws, without regard to its conflict of law provisions.

Entire Agreement

These Terms, Privacy Policy and Cookie Policy constitute the entire agreement between you and LostNFoundAI regarding your use of the App, and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.

By accessing or using the LostNFoundAI App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Payment Policy. If you do not agree to these Terms and Payment Policy, you may not access or use the App.
